Terms of Service

These Terms of Service govern access to and use of RentFind, RentPost and their related pages, services, features, property listings, accounts, communications, publishing tools and payment-related functionality. By accessing, registering for, or using any part of the services, you acknowledge that you have read and understood these Terms and agree to comply with them.

1. Platform status and marketplace role

RentFind and RentPost are technology platforms that facilitate property discovery, advertising, listing management and communication. Unless expressly stated otherwise in a written agreement, the platforms are not the owner of a listed property and are not a party to a tenancy, lease, sale, purchase, agency agreement, management agreement or other private transaction between users.

2. User responsibility

Users are responsible for their own decisions, conduct, communications and transactions. A listing appearing on the platform does not constitute a warranty, certification, recommendation, endorsement or guarantee by RentFind or RentPost regarding the property's ownership, condition, value, availability, legality, suitability, location, measurements, rent, deposit, utilities, security or any other characteristic.

3. Landlord and advertiser obligations

Landlords and advertisers must provide accurate, lawful and current information. They are responsible for having the necessary authority to advertise a property and for obtaining any permissions, consents or approvals required by applicable law. They must not upload deceptive images, false addresses, fabricated amenities, misleading prices, impersonation content, fraudulent payment instructions or information intended to mislead users.

4. User verification and due diligence

Users must independently verify the identity and authority of a landlord, advertiser, agent or other counterparty before making payments or signing agreements. Users should verify ownership or authority to let or sell, physical location, availability, property condition, rent or purchase price, deposits, service charges, utilities, access arrangements and all other material terms.

5. No guarantee of listings

We may provide moderation, automated checks, account controls or other verification features. Such measures are not an absolute guarantee that a listing, user, photograph, document or statement is genuine. Any verification label or platform review reflects the information and checks available to us at the relevant time and should not replace independent due diligence.

6. Property loss, theft, damage and personal safety

To the maximum extent permitted by applicable law, RentFind and RentPost are not responsible for loss of, theft of, damage to, destruction of or unauthorized access to personal property, money, documents, vehicles, electronics, household goods or other belongings arising from a visit to, residence at, occupation of, or transaction concerning a property listed through the platforms. Users are responsible for taking reasonable precautions and for assessing the safety and suitability of a property and its surroundings.

7. Financial loss and transaction risk

To the maximum extent permitted by applicable law, the platforms are not liable for losses resulting from deposits, rent payments, purchase payments, booking payments, service charges, utility payments, fraudulent transfers, scams, unauthorized requests for money, currency changes, failed transactions, delayed transactions or any other private financial arrangement between users. Never send money solely because a property appears on RentFind or RentPost.

8. Personal injury, security and third-party conduct

To the maximum extent permitted by applicable law, RentFind and RentPost are not responsible for personal injury, assault, harassment, intimidation, threats, unsafe premises, criminal conduct, negligence or other acts or omissions of landlords, tenants, agents, visitors, contractors, service providers or other third parties. Users must exercise appropriate caution when meeting unknown persons or visiting unfamiliar properties.

9. Listing content and third-party information

Listings may contain information supplied by third parties. We do not guarantee that every statement, photograph, map position, price, availability status, measurement or description is complete or current. Third-party links, payment services, mapping services and other external services may have their own terms, policies and risks.

10. Availability and technical interruptions

We seek to maintain a reliable service but do not guarantee uninterrupted, error-free or permanently available access. Service interruptions may arise from maintenance, hosting providers, networks, software defects, security incidents, third-party services, power or connectivity failures, force majeure events or circumstances outside our reasonable control.

11. Limitation of liability

To the maximum extent permitted by applicable law, RentFind, RentPost, Ian Gathagu and the platform's founders, personnel, contractors and service providers shall not be liable for indirect, incidental, special, consequential, exemplary or punitive losses, loss of profits, loss of opportunities, loss of data, loss of property, financial loss, reputational loss or other consequential damage arising from use of the platforms or reliance on information obtained through them.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

12. Indemnity

To the extent permitted by law, a user agrees to indemnify and hold harmless the platform owner and its team from claims, liabilities, losses, costs and reasonable expenses arising from the user's unlawful conduct, fraudulent activity, breach of these Terms, infringement of another person's rights, inaccurate listing or private transaction.

13. Accounts and security

Users must keep account credentials confidential and must promptly report suspected unauthorized access. You must not attempt to access another account, bypass security controls, interfere with platform infrastructure or use automated methods in a manner that harms the service.

14. Prohibited conduct

• Fraud, scams, impersonation or deceptive property advertising.
• Publishing unlawful, abusive, threatening or discriminatory material.
• Uploading malware or malicious code.
• Attempting unauthorized access or security testing without permission.
• Scraping or automated collection that violates platform controls.
• Using the service to facilitate unlawful activity.
• Publishing private or sensitive information without authorization.

15. Content, moderation and removal

We may review, restrict, suspend, hide or remove listings, accounts or content where we reasonably believe there is fraud, abuse, security risk, legal risk, a breach of these Terms, or a threat to the integrity of the platform. We may also preserve information where reasonably necessary for security, dispute resolution or legal compliance.

16. Intellectual property

The original RentFind and RentPost software, branding, designs, written materials, database structures, interfaces and other original platform materials are proprietary intellectual property of Ian Gathagu, subject to third-party rights and licenses. Unauthorized copying, reproduction, resale, redistribution, extraction, reverse engineering or creation of derivative works is prohibited except where expressly permitted by law or written authorization.

17. Payments and paid services

Where paid services are offered, the price, plan, entitlement and payment terms displayed at the time of purchase apply. Payment processing may be performed by third-party providers. A payment may be delayed, declined, reversed or unavailable because of circumstances controlled by a payment provider. Users should retain appropriate payment confirmations and transaction records.

18. Changes to the service and these Terms

We may modify features, pricing, publishing rules, technical infrastructure or these Terms as the service develops. Updated Terms will be published on the relevant website. Continued use after an effective update constitutes acceptance to the extent permitted by law.

19. Governing law and legal compliance

These Terms are intended to operate subject to the applicable laws of Kenya. Where a provision conflicts with a mandatory legal right or requirement, that mandatory requirement will prevail to the extent necessary, without invalidating the remaining provisions.
